Acceptance of Terms These Terms and Conditions govern access to and use of the Evntous website, mobile applications, and related services. By browsing, registering, booking, listing services, communicating through the platform, or otherwise using Evntous, you agree to be bound by these Terms and our related policies, including the Privacy Policy and Refund Policy. If you use Evntous on behalf of a business or organization, you confirm that you are authorized to bind that business or organization to these Terms. 2. About the Platform Evntous is a marketplace that helps customers discover event-related venues and vendors, submit booking requests, receive confirmations, manage event planning, communicate with counterparties, and complete payments through supported payment channels. Unless expressly stated otherwise, Evntous provides the marketplace infrastructure and administrative tools but may not itself be the direct provider of each vendor service listed on the platform. 3. Eligibility and Accounts Users must provide accurate, current, and complete registration information. Users are responsible for keeping login credentials, OTPs, and devices secure. Users must not create accounts using false identities, misleading information, or unauthorized third-party details. Evntous may suspend, restrict, or terminate accounts that violate these Terms, applicable law, or marketplace rules. 4. Customer Use of the Platform Customers may browse as guests where enabled, but certain actions require identity verification or account creation. Customers are responsible for ensuring booking details, event dates, venue information, selected services, and special requests are accurate before submission and payment. A booking request is not guaranteed until the relevant vendor confirms availability and any required payment is completed within the applicable payment window. Customers must not use the platform to submit unlawful, abusive, deceptive, infringing, or fraudulent content or requests. 5. Vendor Use of the Platform Vendors must maintain accurate business, service, pricing, availability, lead-time, and policy information. Vendors are responsible for ensuring that listed services comply with applicable laws, licensing requirements, industry standards, and contractual obligations. Vendors must respond to booking requests, deliver services as confirmed, and communicate professionally with customers through approved channels. Evntous may moderate, remove, suspend, or de-prioritize vendor listings or accounts where there is non-compliance, poor service quality, misrepresentation, or legal risk. 6. Bookings, Confirmations, and Changes Customers may submit booking requests for one or more vendors or services through the Evntous workflow. Each vendor may review, confirm, reject, or allow the request to expire based on its availability and policy settings. A vendor-specific booking may carry its own payment deadline, cancellation conditions, and fulfillment timeline. If a booking is edited before payment or where platform rules permit edits, the booking may return to a pending review state and require renewed vendor confirmation. If a vendor declines or times out, Evntous may display alternate vendors or replacement options, but does not guarantee identical pricing, availability, or service terms. 7. Pricing, Taxes, and Fees Prices shown on the platform may include or exclude VAT, platform fees, service fees, delivery fees, or payment-related charges as indicated at checkout or in the booking summary. Promotions, discounts, wallet credits, and installment options are subject to eligibility rules and may be withdrawn or invalidated if used improperly. Evntous may correct genuine pricing or content errors. Where such an error materially affects an order, the affected user may be offered the option to proceed on the corrected basis or cancel the affected order. 8. Payments Payments may be processed through approved third-party payment providers and may support methods made available in the Kingdom of Saudi Arabia, including cards, digital wallets, bank-related methods, and approved installment services. The customer authorizes Evntous and its payment providers to charge the selected payment method for the amounts due in connection with the booking. A booking may be cancelled automatically if payment is not completed within the stated payment window. Where split, staged, deposit, or installment payments are supported, the specific payment schedule and consequences of non-payment will be shown in the applicable booking flow. 9. Payouts to Vendors Where Evntous facilitates marketplace payout flows, vendor payouts are subject to platform configuration, successful receipt of customer funds, verification status, fraud checks, applicable deductions, and payout provider availability. Evntous may delay, hold, offset, or reverse payout processing where reasonably required for disputes, chargebacks, suspected fraud, policy breaches, incomplete verification, legal compliance, or mistaken payments. 10. Cancellations and Refunds Cancellations and refunds are governed by the applicable booking terms, vendor policy, platform rules, payment status, service stage, and the Evntous Refund Policy. Different vendor sub-orders or services within the same event may be treated separately for cancellation and refund purposes. Where the law grants mandatory rights to consumers, those rights will apply even if a stricter contractual policy appears elsewhere. 11. Communications and Messaging Users may communicate through in-app chat, notifications, email, SMS, WhatsApp, or support channels where enabled by Evntous. Users must not misuse communications tools for harassment, spam, scams, off-platform circumvention, unlawful marketing, or sharing prohibited content. Evntous may monitor, review, retain, or disclose communications to the extent reasonably necessary for security, support, dispute handling, or legal compliance. 12. Reviews, Ratings, and User Content Users may submit reviews, ratings, images, comments, notes, and other content where features allow. Content must be truthful, lawful, relevant, non-defamatory, and must not infringe the rights of others. By submitting content, the user grants Evntous a non-exclusive, royalty-free, worldwide license to host, use, reproduce, display, moderate, and distribute that content for operating and promoting the platform, subject to applicable law and privacy rights. Evntous may remove content that violates these Terms or creates legal or operational risk. 13. Collaborator Features Event owners may invite collaborators to view or assist with planning, subject to platform permissions. Unless Evntous expressly enables otherwise, collaborators may not make payments, cancel bookings, or finalize legally binding event commitments without the event owner’s authorization. The event owner remains responsible for actions performed through their event workspace, including permissions granted to collaborators. 14. Prohibited Conduct Using the platform for fraud, impersonation, money laundering, prohibited services, illegal activity, or circumvention of platform controls. Attempting to access another user’s account, data, booking, or payment details without authorization. Uploading malware, interfering with platform security, reverse engineering restricted components, or overloading the service. Bypassing payment flows, fees, or commission structures where such bypass violates marketplace rules or contractual commitments. 15. Suspension and Termination Evntous may investigate suspected violations and may suspend, limit, or terminate access immediately where needed to protect users, the platform, or legal compliance. Termination does not eliminate obligations that accrued before termination, including payment obligations, dispute cooperation, indemnities, and recordkeeping requirements. 16. Intellectual Property The Evntous brand, software, interface, marketplace structure, designs, text, graphics, and related intellectual property are owned by or licensed to Evntous unless otherwise stated. Users may not copy, reproduce, modify, distribute, or commercially exploit platform materials except as permitted by law or with written authorization. Vendor trademarks, logos, and content remain the property of their respective owners, subject to rights granted for platform display. 17. Disclaimers Evntous seeks to provide a reliable marketplace but does not guarantee uninterrupted availability, error-free operation, or that every vendor, booking, or listing will meet every user expectation. To the maximum extent permitted by law, marketplace recommendations, rankings, and search results may be influenced by relevance, availability, commercial factors, quality signals, and platform policies. Nothing in these Terms excludes rights that cannot lawfully be excluded under applicable consumer or other mandatory laws. 18. Limitation of Liability To the extent permitted by law, Evntous will not be liable for indirect, incidental, special, consequential, exemplary, or loss-of-profit damages, or for losses arising from third-party services, vendor performance, force majeure events, unauthorized account access caused by user negligence, or the user’s own misuse of the platform. Any limitation of liability in these Terms is subject to mandatory legal rights and does not apply where liability cannot be limited under applicable law. 19. Indemnity Users agree to indemnify and hold harmless Evntous, its affiliates, officers, employees, and agents from claims, losses, damages, liabilities, and costs arising from their misuse of the platform, breach of these Terms, violation of law, or infringement of third-party rights, to the extent permitted by law.
